Marijuana Business Licenses Are Capped

The number of licensed marijuana locations in the City are limited by the Code of Laws to five places that sell marijuana to the consumer (medical dispensaries/centers, retail stores, co-locations) and three manufacturers of infused products. Cultivation is self-limiting in that the law prohibits free-standing operations. Any cultivation for commercial marijuana in the City must be contiguous to a retail marijuana store/medical marijuana center or marijuana infused products facility under the same ownership. Contiguous means the spaces are either unitary or share a vertical wall with access between operations via the wall (i.e., a door or doorway that allows going from the cultivation to the dispensary or infused products facility without having to go into an area with public access).

Marijuana Testing Licensing

The City Council approved Ordinance 1598 allowing medical marijuana testing and co-location of medical and retail marijuana testing. The ordinance becomes effective on July 15, 2016. Retail marijuana testing remains allowed and is permitted in industrial-employment and commercial-1 zoned properties that also meet building code specifications. With the exception of marijuana testing, there are currently no marijuana license vacancies in Wheat Ridge.

Legal Non-conformity

Some of the existing locations within the City are considered legal non-conforming uses the Code. The locations fall within the buffer zones established by the Code but until license-relinquishment or revocation occurs each of these locations is lawful and permitted.

Limitations on Primary Caregiver Activities

The Code limits the amount of space and the location within a residence used for primary caregiver growing and processing activities. The Code also prohibits the use of compressed combustible gases for processing marijuana in a residential building and prohibits the use of accessory structures for primary caregiver activities.
