Colorado Stormwater General Permit for Construction Activities
Although the City of Wheat Ridge has obtained a Phase II Stormwater Permit from the State of Colorado, it is up to each developer of land within Wheat Ridge to obtain a Colorado Stormwater General Permit for Construction Activities directly from the Colorado Department of Public Health & Environment (CDPHE). This is in addition to any City related Zoning or Land Development approvals you may receive.

You may need a permit to discharge stormwater from any construction activity that disturbs at least one acre of land or is part of a larger common plan of development or sale that will disturb at least one acre.

Construction Greater Than One Acre
Any person or organization who wishes to disturb greater than one acre of land must do one of the following:
  • Obtain permit coverage under Colorado's Stormwater General Permit for Construction Activities.
  • Apply for coverage under the R-Factor Waiver from the CDPHE
    • The Stormwater Construction Fact Sheet from the Colorado CDPHE is an excellent resource in understanding your commitments to the Colorado Stormwater General Permit. You should allow yourself at least 10 business days to acquire a permit from the Colorado Department of Public Health and Environment.
    • The Stormwater Discharge Permit (SDP) application form can be obtained from CDPHE.
    • The Fugitive Dust Control permit application form can be obtained from CDPHE.
    • CDPHE also offers guidance on how to prepare a Storm Water Management Plan (SWMP) for Construction Activity.
